Unsafe overtake on A99 near Lybster leads to fine for driver





A driver attempted to overtake a vehicle when it wasn't safe to do so and only just managed to return to his own side of the road, Wick Sheriff Court heard last week.

Neophytos Paphitis (59) admitted a charge of careless driving – reduced from one of dangerous driving – and was fined £300. He also incurred three penalty points.

The court was told that the property manager was holidaying in Scotland when he pulled out on a long straight stretch of road on the A99, south of Lybster, on August 18, last year, observed by other drivers who thought he was "cutting it a bit fine".

Fiscal David Barclay said that the accused managed to complete his overtaking procedure and avoid a collision with an oncoming vehicle – but added that, in hindsight, it was "not an appropriate time or place to have attempted to do so".

Paphitis was said to be living in temporary accommodation following a fire that damaged his home at Newhouse Lane, Albrighton, Wolverhampton.
