Pair refused drink-drive breath test at Wick police station

A Falkirk man suspected of drink-driving turned nasty after he was arrested, Wick Sheriff Court heard.

After being taken to Wick police station early on March 25, Ian Halloran and Brian Morrison both refused to provide preliminary breath tests.

Procurator fiscal David Barclay said Halloran seemed to be upset at finding himself in custody and threatened to fight with officers.

Halloran (38), of Braeside Park, West Quarter and Morrison (33), of Jackson Avenue, Grangemouth, both admitted unreasonably failing to provide a test when it had been suspected that they had driven a van while over the drink or drug limit.

Each admitted a similar previous conviction.

Halloran also admitted threatening or abusive behaviour.

Josie Donachie, for Halloran, asked Sheriff Neil Wilson to restrict the driving ban as his licence is useful for his work.

Fiona MacDonald, for Morrison, said he requires his licence to get to and from his work.

Sheriff Wilson banned both from driving for three months.

Turning to the threats Hollaran made to police, the sheriff said it was "entirely unacceptable behaviour".

On this charge, he fined him £300 along with a £20 victim surcharge.
