Altnabreac train trial couple warned after failing to show at court
A couple accused of blocking trains at a Caithness level crossing have been warned to expect to be arrested if they fail to appear for their trial.
Ian Appleby and Elizabeth Howe were absent when their pre-trial hearing was called at Wick Sheriff Court today.
Their solicitor, Fiona MacDonald, said she had been informed Appleby had to deal with a medical emergency on Wednesday evening.
"I don't know if that was in hospital or at home," she said.
Ms MacDonald said both accused are adhering to their previously tendered not guilty pleas.
They deny endangering life by standing in the path of trains near their home in Altnabreac.
Appleby (48) and Howe (49) deny culpably and recklessly standing on the tracks in the path of oncoming trains to the risk of injury and danger of life to themselves, passengers and staff on the train.
It is alleged they had “utter disregard for the consequences” when they crossed barriers on to the level crossing when trains were approaching on March 1 last year.
They also deny shouting, swearing and making abusive comments towards two police constables and struggling with them.
Sheriff Principal Eilidh MacDonald noted that the last occasion the couple appeared in court in connection with the case was April 1.
Addressing the defence agent, she said: "They may not be aware how important it is for them to be here. I'm sure you have made them aware of that but I want to make it doubly clear that they have to be here for their trial."
She warned that another no-show is likely to result in a warrant being issued for their arrest.
The sheriff principal added: "I will excuse them today but medical vouching should be lodged to explain their non-appearance."
Appleby and Howe, who live in the former station house at Altnabreac, are to face trial on September 2.
They remain on bail which includes a special condition banning them from the level crossing and the rail track.
